Dear Mr. Cox:
I am in receipt of your Feb. 16 letter attempting to extract monies from me in the amount of $12,532.86. You have apparently contracted with the Georgia Department of Revenue (hereinafter referred to as GADOR), which to date has failed to respond to any of my administrative attempts to settle this. Since the GADOR seems to have tired of sending me unsigned, unsworn threats and harassing letters, they apparently have turned to your company to ratchet up the terrorism against my family and me.
This is not a refusal to pay, however I do not wish to waive or fail to exercise any rights and protections I may enjoy under the laws of this country. Therefore, per the Federal Fair Debt Collection Practices Act(hereinafter referred to as FDCPA), please note of the following:
a. I am DISPUTING this alleged debt. I dispute, deny and disagree with the figures submitted in your letter.
b. I demand validation of the alleged debt that I allegedly owe. This has to be either an order signed by a JUDGE FROM A COURT OF COMPETENT JURISDICTION, or a written statement by an officer or principle of the department that originated the debt and SIGNED UNDER PENALTY OF PERJURY. Anything other than a certified copy of one of the above documents fails to meet the requirements set out in the FDCPA.
c. Your letter did not mention if you have purchased this debt or if you are representing the party that originated the debt. Please also disclose this in your response.
In addition, please provide your social security number in your response (since you obviously have free use of and access to my social security number without my consent). I will need yours, because if this matter goes to trial, I want to make sure I sue the correct parties for violation of the FDCPA and my rights.
I also wish to make plain that although the statutory limit on damages for violations of FDCPA is $1000.00, the law allows me to sue for unlimited damages for INTENTIONAL INFLICTION OF EMOTIONAL ANGUISH. I have expended too many months to recount trying to resolve this problem with the GADOR, all to no avail.
The GADOR has ruined my credit rating and my good name, and now has enlisted you in further harassment and terroristic threats towards my family and me. Unfortunately, I am compelled to respond at this time so it will not appear as though I have waived rights I may enjoy under the law.
