The Facts on Leitgeb's Criminal Trial
Can you trust that transcript?

These are the comments I posted to AHRC.com in hopes that they will make it to Washington.

My story is a little different, but just as applicable on the issue of due process.  My transcript was methodically altered for my criminal trial. 

After 4 months in a state boot camp, I finally had the opportunity to read my transcript.  If I did not know better, I might have thought I attended a different trial.  I knew very well that the court erred, but when I went back to look for them they were not there.  Every single issue of relevance that I wanted to verify had disappeared from the transcript.

I remember distinctly an outburst on the part of an officer.  That outburst was incorporated into his testimony.  I remember the judge saying that the law is what he says the law is.  That statement was never recorded.  The judge also said that Supreme Court rulings from Texas and Arizona don't apply in his court. That statement, the first comment of a new session, simply disappeared. An officer testified that he would give a ticket to someone, even if he did not see the offense.  His statement was changed into him saying that he would NOT do such a thing.

When my lawyer tried to get the transcript, it took forever.  The court kept claiming that the court reporter was ill.  I believe that the real cause for the delay was the time it took to alter the transcript so that I would not have any chance of an appeal.

These alterations may be provable even after all this time.  A jury is likely to remember such things as an outburst from an officer.

It occurred to me that we have 9 Supreme Court justices sitting in Washington DC day after day who deliberate on pertinent issues of the day who think that the decisions they make are relevant.  They are not!  They make decisions based on the transcript.  They can't deliver justice if the transcripts they see have been altered.

What procedures are in place to prevent a lower court from changing the transcripts?  Is there an organization or an agency that routinely audits the lower courts?  If a conspiracy is unraveled, will the judge and/or the prosecutor face prison time?  These are the issues that must be addressed to restore faith in the American justice system.
