ORDER APPOINTING NEXT FRIEND FOR PLAINTIFF AND SETTING
CONDITIONS OF SAME AND ADDRESSING PRE-TRIAL ISSUES
This matter came on for hearing on Plaintiffs Motion for Next Friend Status and upon the
Court’s continuation of a Pre-Trial Conference and the Court finds and orders as
follows:
A.
I. That the Plaintiff has presented health concerns to the Court warranting the appointment
of a next friend.
2. That the Court accordingly appoints Carl R. Weston as next friend of James H. Weston
under the conditions set forth hereinafter.
3. That Carl R. Weston acting as next friend for purposes of Pre-Trial and Trial
proceedings
shall:
a. Be allowed to sit at counsels table with Plaintiff.
b. Make any opening and closing statement on behalf of Plaintiff
c. Conduct direct and cross examination on behalf of Plaintiff of all witnesses,
d. Make any argument, response, or objection to the Court on behalf of the
Plaintiff
e. Offer and seek admittance of any exhibits offered by Plaintiff
4. That Plaintiff shall communicate solely through his next friend, save and except for the
testimony of the Plaintiff
5. All filing and notices should be directed to Carl R. Weston as next friend of Plaintiff
James H. Weston at 2851 N. Highway 66, #17 Catoosa, OK 74015.
B.
That the Court has circulated to the parties a proposed Pre-Trial Order this date, and has
asked
the parties to respond within seven days with the following:
1. Any information set forth or left out of the proposed Order which is inconsistent with the
discussion held by the Court with the parties on April 25, 2005.
2. Any additional information requested.
3. The Court will then prepare a final Pre-Trial Order and file and provide copies to the
parties.
