PLAINTIFFS' MOTION FOR RECONSIDERATION
1. The Plaintiffs in this action – Harold Patriot and Sherrie Patriot – hereby file this Motion to reconsider the Court’s Order of March 31, 2009, dismissing Plaintiffs’ complaint while upholding Defendants’ counterclaim.
2. There is sufficient evidence to support Plaintiffs’ position that the Statute of Limitations does not bar the filing of their complaint. Plaintiffs also believe that the Court committed an error in fact and law in not dismissing Defendants’ counterclaim.
3. Pursuant to LCvR 7(m), Plaintiffs’ counsel conferred by e-mail with Defendant’s counsel Mr. Benjamin J. Weir who opposed filing this motion.
4. A memorandum and a proposed order accompany this motion.
