Plaintiff, Valdy Patriot received a letter from opposing party Counsel dated September 19, 2007, where government agreed to pay plaintiff's filing fees. Counsel stated also, to provide an itemized list of expenses so that the United States can consider simply paying them and concluding this case.
1. Plaintiff placed phone calls on 9/21/07, 9/28/07, 10/05/07, 10/08/07, 10/09/07 to Counsel and left messages to speak.
On 10/01/07 and 10/08/07 Plaintiff emailed Counsel with this message:
Mr. Harris, I plan to file motion for Summary Judgement.

2. Resolution was not agreed. Counsel for Defendant only made contact by letter dated September19, 2007. Plaintiff's emails and phone calls were not returned to this day.
